The general terms and conditions of the PANCHO online store are drawn up following the Consumer Protection Act1 (ZVPot-UPB2) based on the recommendations issued by the Chamber of Commerce and Industry of Slovenia and international e-commerce codes. The protection of your personal information is regulated by the Privacy Policy. General Terms and Conditions and Privacy Policy are published on our website www.pancho.si. Changes to the General Terms and Conditions and Privacy Policy become effective on the day they are published and are binding for the website user.

General Terms and Conditions are always published on our website. The buyer is bound by the General Terms and Conditions applicable at the moment of purchase (placement of online order).
PRODUCTS OFFERED
Website www.pancho.si provides products for pets, with emphasis on dog suits for various occasions. All apparel is made of quality materials and comes in various sizes, which makes it suitable for several dog breeds. Every product contains a detailed description of its' features (size, material and other technical details).
AVAILABILITY OF PRODUCTS
Our products are available in Slovenia and abroad. We aim to deliver the products you have ordered in the shortest possible time. If we are unable to deliver the product due to logistics or any other problems, you will be notified in advance via email.
EMAIL ADVERTISING
FORTUN-5 je zavezanec za plačilo davka na dodano vrednost (DDV). Cene so v evrih (EUR), veljajo v trenutku oddaje naročila in nimajo vnaprej določene veljavnosti.
YOUR ORDER
An order can be placed by a natural person or legal entity. If a legal entity is making the purchase, additional fields need to be filled in for the identification of the legal entity and responsible person of the legal entity. The order is valid when placed by the buyer by clicking the complete purchase button in the basket. In case of suspicion that an order has resulted in a fraud on the online store, we reserve the right to reject the order. By placing an order, the buyer also confirms that he is familiar with these general terms and conditions and that he has been expressly notified of them.
Prodajna pogodba med FORTUN-5 in vami kot kupcem je v spletni trgovini www.pancho.si sklenjena v trenutku, ko vam FORTUN-5 pošlje prvo elektronsko sporočilo o potrditvi naročila. Od tega trenutka naprej so vse cene in drugi pogoji določeni in veljajo tako za FORTUN-5 kot za vas. Prodajno pogodbo hranimo v elektronski obliki. Na vašo pisno zahtevo vam jo lahko kadarkoli posredujemo preko elektronske pošte.
PAYMENT OPTIONS
We accept the following methods of payment at www.pancho.si:
- cash on delivery,
- bank transfer to the company’s account based on the pro forma invoice...
All prices are in Euro (EUR) and include the value-added tax (VAT) but not the cost of delivery. Prices and discounts valid at the time of the order apply. Expiry dates for promotional prices are specified in the online store.
DELIVERY
We cooperate with several courier companies for the delivery of ordered goods. The buyer is informed of the courier delivery charge prior to placing the order. After the buyer has fully paid for the product, the parcel will be submitted to the selected courier company in two working days.
We aim to deliver the ordered goods in no more than 14 days. If the product is not in stock at the time of order or there are other logistic issues, the delivery time may be longer. You will be informed of it in advance via email.
In case you don’t wish to wait on out of stock product, please inform us and we will remove the item from your order.
DAMAGED OR LOST GOODS
We are not liable for any damages caused by courier companies. If upon receipt you noticed your parcel is damaged, priorly opened and has goods missing or damaged as a result of it, you can launch an investigation via the shipping company that delivered it. This must generally be done immediately after receiving a defective package. If you have any further questions or require our assistance in such cases, you can contact us.
ISSUE OF INVOICE
The buyer receives the invoice for ordered goods by mail (in the parcel together with the ordered goods) and this constitutes proof of payment made by the buyer in full before the order was placed. The invoice states the price and all the costs relating to the purchase.
DISCOUNT CODES
If the user has a valid discount code, they need to enter it in the selected box in the order form.
HOW TO USE DISCOUNT CODE
When placing your order fill in the required information and also type in the discount code if you have it. Only one discount code can be used per purchase. Promotions, discount codes, and free shipping are mutually exclusive and cannot be combined.
PURCHASE
You can place your order on www.pancho.si online store by filling in the order form. In order to complete your order, you need to fill in all the fields marked with an asterisk:
1. Delivery address
Provide the required contact details marked with an asterisk (name, surname, address, city, postal code, email address) we need to confirm and complete the order and deliver the goods.
2. Delivery cost
The price of delivery will be clearly marked in the form used to submit the order. In case your order qualifies for complimentary shipping, that will also be evident in the same form. Ordered goods will be delivered via the shipping company.
3. Payment options
Izberete lahko med naslednjimi načini plačila:
- cash on delivery,
- bank transfer to the company’s account based on the pro forma invoice...
4. Discount Code
If the user has a valid discount code, he needs to enter it in the selected box in the order form.
5. Purchase completion
Your purchase is completed when you have received confirmation of payment with an overview of the placed order to your email address. The buyer needs to communicate any changes in no more than 24 hours to our email address info@pancho.si or +386 70 787 777.
CONSUMER'S RIGHTS
With distance contracts, you have the right as a consumer to inform us unambiguously within 14 days via email or any other communication channel that you are withdrawing from the contract without stating the reason for your decision. In no more than 14 days after you have informed us of the withdrawal, you need to return the goods to EKO DAN. You are to return the goods to Litijska cesta 35, 1000 Ljubljana.
Najkasneje v roku 14 dni od oddaje obvestila o odstopu od pogodbe morate podjetju FORTUN-5 vrniti blago na naslov Vojkova cesta 58, 1000 Ljubljana. Blago je potrebno vrniti nerabljeno, nepoškodovano, nespremenjeno in v originalni nepoškodovani embalaži z vso priloženo dokumentacijo. V nasprotnem primeru vračilo blaga ni mogoče. Neposredne stroške vračila blaga nosite kupci blaga. Pri vračilu blaga je potrebno pošiljki predložiti račun za kupljeno blago, obenem pa pripišite vaše osebne podatke in transakcijski račun, na katerega želite prejeti vrnjeno plačilo. Vračilo plačila bomo opravili v 14 dneh od prejema obvestila o odstopu od pogodbe.
Pri odstopu od pogodbe, kjer je bila koriščena koda za popust oziroma promocijska koda, se ta sredstva upoštevajo kot popust in se ne vrnejo. Na vaš TRR se vrne le plačani znesek, obenem pa se vrne tudi promocijska koda v obliki nove kode.
Skladno z veljavno zakonodajo odgovarjamo za morebitne stvarne napake na naročenih izdelkih. Morebitno reklamacijo sporočite po izbranem komunikacijskem kanalu, vrnjenemu blagu pa mora biti priložena kopija originalnega računa. O stanju reklamacije vas bomo sproti obveščali.
EMAIL ADVERTISING
FORTUN-5 bo z vami stopil v stik preko sredstev komunikacij na daljavo le, če se s tem strinjate. Oglasna elektronska sporočila bodo vsebovala naslednje sestavine:
- clearly and unambiguously marked as commercial messages
- the sender will be clearly shown, various campaigns, promotions and other marketing techniques will be marked as such
- the terms for participation will also be clearly set out
- clear and conspicuous unsubscribe option, users’ wish not to receive advertising messages will be strictly obliged
EXCLUSION OF LIABILITY
We reserve the right to shut down the website or prevent access to it for technical and other problems and maintenance, which also means disrupted or no access to the online store. In the event of technical problems on the website, we reserve the right to cancel all submitted orders affected by the technical problem. If your order has been canceled, you will be informed of it in the shortest possible time and instructed what to do next. Users need to make sure they have relevant software (antivirus) protection in place before accessing and using the website.
GRAPHIC DESIGN
Spletna trgovina www.pancho.si in vse objavljene vsebine (npr. podatki in slike artiklov, grafični in video elementi itd.) so zaščiteni in jih ni dovoljeno reproducirati ali uporabljati brez predhodnega pisnega dovoljenja podjetja FORTUN-5.
COMPLAINTS AND DISPUTES
We comply with the applicable European laws on consumer protection and we will do everything in our power to fulfill our duties; Including, but not limited to: setting up an effective complaint handling system and appointing a person the buyer may contact in the event of problems over the phone, via email or regular mail.
Pritožbo lahko oddate preko elektronskega naslova info@pancho.si, preko telefonske številke 070/787-777 ali na naslov Vojkova cesta 58, 1000 Ljubljana. Postopek obravnave pritožbe je zaupen. Najkasneje v petih delovnih dneh bomo potrdili prejem pritožbe in vam sporočili predviden čas njene obravnave ter vas vseskozi obveščali o poteku postopka.
We are aware of the disproportion between the economic value of the claim and the costs incurred in the court of law when it comes to handling consumer disputes in court. This is also the key reason why consumers generally do not opt for resolving their dispute in a court of law. Given that information, we will make every effort to solve any dispute by mutual agreement. In the event of litigation, the court of consumer’s permanent residence will have the jurisdiction.
OUT-OF-COURT RESOLUTION OF DISPUTES
In accordance with the legal standards, we do not recognize any facilitator of out-of-court resolution of consumer disputes to be competent to resolve a consumer dispute that a consumer might engage in accordance with the Out-of-Court Settlement of Consumer Disputes Act.
